We at Si Property Consultants Chartered
Surveyors, can advise landlords, tenants or occupiers on
their property repairing obligations, mid to end term
dilapidations claims and general lease agreements or
licence to alter requirements.
Dilapidation is a specialised and complex part of property law
dealing with dis-repair, redecoration and reinstatement
obligations. Recent judicial
reforms and the dilapidations protocol put an onus
on the parties to the lease to ensure that claims and settlements are
achieved promptly.
Whether you are a tenant or a landlord
of a shop, office, restaurant, warehouse
or commercial
property with a lease or licence, there will be
specific repairing duties and liabilities to be aware of. Before taking on a
new lease it is important to commission a surveyor to prepare a Schedule of
Condition in order document this into to a new lease and potentially
mitigate repairing obligations and claims you may incur at the end of the
lease.
We can advise both the landlord and tenants on repairing obligations,
produce a schedule of defects and breach of covenants, or
review a claim already produced by the landlord and undertake
settlement negotiations.
If you are the landlord, we can help prepare a Schedule of Dilapidations
setting out the repairing, redecoration and reinstatement claim in accordance with
obligations contained in the lease
agreement. If you are the Tenant we can advise whether the
schedule and claim (provided by the Landlord) is reasonable or not and
negotiate settlement on your behalf.
