Party Walls Etc. Act 1996 The Party Wall Etc Act 1996 (applies in England and Wales only) will affect you if, you or a neighbour are planning to carry out construction work which will alter, demolish or build upon a Party Structure (wall, floor or fence) on or near the adjacent owner's land/property. It will also apply where there is an intention to excavate for foundations close to a neighbouring building(s) or build upon an unbuilt boundary between two properties. The Act requires the service of notices, the appointment of party wall surveyors in the event of dispute and the publication of an 'Award'. The Award is an agreement to ensure that the proposed works will maintain the integrity of the Party Structure or boundary development affected by the works. Party wall surveyors are required to act impartially. A single party wall surveyor can therefore act for two or more owners and this is often an effective way to keep the costs down. We can act as Party Wall Surveyor for owners carrying out works, or neighbours that have been served with a notice, or even act for both as a single (agreed) surveyor.
