Dilapidations and Schedules of Conditions

Dilapidation is a specialised and complex part of property law. Recent judicial reforms have put an onus on the parties to the lease to ensure that claims and settlements are achieved promptly and diligently following judicial procedures and guidelines.

Whether you are a tenant or a landlord, if you are a party to a lease, then there will be specific repairing duties and liabilities to be aware of. Before taking on a lease it is important to commission a surveyor to prepare a Schedule of Condition, in order to record the condition of the property and thus potentially mitigate repairing obligations and claims you may incur at the end of the lease.

We can advise both the landlord and tenants on repairing obligations, produce a schedule of defects and breach of covenants, serve it upon the relevant party and undertake negotiations.

During the lease, or even at the end, we can help prepare a Schedule of Dilapidations setting out items that are to be repaired or replaced in accordance with the lease. We can advise whether the schedule and claim is reasonable or not.
